Dear Minister of Labour and Social Security,

I am concerned that the consitutional amendments passed in September 2010, which were intended to improve workers' access to their rights, do not provide for full compliance with International Labour Organisation (ILO) standards.

Having ratified the ILO core Conventions 87 and 98 Turkey is obliged to guarantee workers’ fundamental rights to freedom of association, to organise, bargain collectively and to strike. In 2011 the ILO Committee of Experts issued a series of recommendations to the Turkish authorities to bring legislation into conformity with their standards but they are yet to be implemented.

As such, I call on you to ensure that:

  • Trade unionists and other workers can exercise their internationally recognised rights, as set out by the ILO conventions that Turkey has ratified;
  • Domestic legislation complies with ILO standards governing the rights to organise, to strike and to bargain collectively, in both the private and public sectors
  • As a first step, the constitution and domestic law is amended to ensure that public sector workers enjoy full collective bargaining rights and the right to strike.
